Terms of Use
Color Legal LLC · Last updated October 28, 2026
These Terms of Use (the “Terms”) govern your access to and use of colorlegal.com and every page, form, download, video, and product offered through it (together, the “Site”). The Site is operated by Color Legal LLC, a New York limited liability company (“Color Legal,” “we,” “us,” or “our”). By accessing the Site, submitting a form, or making a purchase, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, do not use the Site.
You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of a law firm or other organization, you represent that you have authority to bind it, and “you” includes that organization.
Our programs are built for plaintiff-side attorneys and the legal professionals who work with them. Color Theory, Color Study, and Color Theory for Firms are offered by application only.
We may accept or decline any application for any reason or no reason, and we are not required to explain a decision. Submitting an application creates no obligation on either side and does not guarantee acceptance. You agree that everything you tell us in an application, including your bar admission status and the nature of your practice, is accurate and complete.
2. EDUCATIONAL CONTENT, NOT LEGAL ADVICE
Everything on the Site and in our products and programs is educational content about litigation strategy and practice. It is not legal advice and is not a substitute for your own independent professional judgment.
Color Legal is not a law firm and does not provide legal services. Nothing on the Site, in any product or program, or in any communication with us creates an attorney-client relationship between Color Legal, Cristina Delise, or anyone affiliated with us and you or any of your clients.
Cristina Delise is a practicing attorney. Her work with Color Legal is separate from her law practice, and the views expressed on the Site are her own and not those of any law firm with which she is or has been affiliated.
You are solely responsible for every decision you make in your matters and for complying with the rules of professional conduct, court and local rules, judges’ individual practices, protective and scheduling orders, and all other law and rules that apply to you and your cases. Verify any approach, template, or technique against the law and rules of your jurisdiction before you use it.
Prior results. Verdict and settlement figures on the Site describe matters on which Cristina Delise worked, frequently as one member of a larger litigation team, and are stated in the aggregate. Prior results do not guarantee a similar outcome. We do not promise that any product or program will produce any particular result in any matter.
Continuing legal education. Unless an offering states otherwise in writing, our products and programs are not accredited for continuing legal education credit in any jurisdiction.
3. CLIENT AND CONFIDENTIAL INFORMATION
Do not submit privileged, confidential, or protected client information through the Site. That includes attorney-client communications, attorney work product, material subject to a protective or sealing order, protected health information, and anything else you are not authorized to disclose. When an application asks about a matter, describe it at a general level, without client names or identifying details.
Information you submit through the Site, including applications and questions, is handled under our Privacy Policy. We do not receive it in confidence as part of any attorney-client relationship, and you are responsible for deciding whether sharing it with us is consistent with your professional obligations, including your duty of confidentiality.
If you are accepted into an engagement that involves case materials, including Color Study, the handling of those materials is governed by the separate written terms for that engagement. Do not send case materials until those terms are in place.
4. PURCHASES AND PAYMENT
Pricing. Prices are stated in U.S. dollars and may change at any time. A price change does not affect an order we have already accepted. Founding, introductory, or limited-time pricing applies only for the period and on the terms we state.
Payment. Payments are processed by third-party payment processors, including Stripe. We do not receive or store your full card number. You authorize us and our processors to charge the payment method you provide for the full purchase price and any applicable taxes. If you choose financing through Affirm, that arrangement is between you and Affirm and is governed by Affirm’s terms. Color Legal is not a lender and is not a party to it.
Digital delivery. Downloadable products, including the Pretrial Exhibit System and the Pretrial Checklist, are delivered electronically, which may be through a single-use or time-limited download link. You are responsible for downloading and saving your files when you receive them. If you have trouble accessing a file, contact us at [email protected].
All sales are final. Digital products are delivered immediately and cannot be returned. We do not offer refunds, credits, or exchanges on any purchase, except where applicable law requires otherwise.
Program-specific terms. Some offerings carry their own written terms, including the Color Theory enrollment terms and the engagement terms for Color Study. Those terms govern the offering they cover and control over these Terms if the two conflict.
Payment disputes. If you have a problem with a charge, contact us first. If you initiate a chargeback or payment dispute, we may suspend your access to all products and programs while it is pending.
5. INTELLECTUAL PROPERTY AND LICENSE
The Site and everything in it belong to Color Legal or its licensors and are protected by copyright, trademark, trade secret, and other law. That includes the C.O.L.O.R. framework as we present and teach it, course modules, videos, text, templates, checklists, charts, spreadsheets, sample work product, graphics, and the Color Legal name, logo, and program names.
Your license. When you purchase a product or download free materials, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use them in your own legal practice, on matters you personally handle or supervise. An individual purchase licenses one person. Use by anyone else at your firm requires a separate purchase or a firm license. The case information you enter into a template is yours. The template itself remains ours.
Restrictions. Without our prior written permission, you may not:
- copy, share, post, distribute, sell, resell, sublicense, or give away any product, template, video, or program material, in whole or in part, including blank or lightly modified copies of a template;
- share your download link, login credentials, or program access with anyone;
- use our materials, or anything derived from them, to create, teach, present, or sell any course, CLE, seminar, webinar, training, template, or product;
- use our materials to train, fine-tune, or develop any artificial intelligence model, or to build any dataset, tool, or product;
- record, screen-capture, scrape, or download videos or other content except through features we provide; or
- remove or alter any copyright, trademark, or other proprietary notice.
Any use outside this license ends your license automatically, and you must delete all copies of our materials in your possession.
6. YOUR CONDUCT AND SUBMISSIONS
Conduct. You agree not to use the Site in violation of any law; submit false information or impersonate anyone, including by misstating your bar admission or practice; access or attempt to access any part of the Site, account, or system without authorization; use bots, scrapers, or other automated means to access the Site; introduce malware or interfere with the Site’s operation or security; or harass, threaten, or abuse us or any other participant.
Questions and feedback. Questions, comments, suggestions, and feedback you send us, including questions submitted for Office Hours, may be answered in a group setting that other participants can see or hear. Do not include confidential information in them. You grant us a perpetual, worldwide, royalty-free license to use what you send us to operate and improve our products and programs, without any obligation to you.
Aggregated information. We may use information from applications, forms, and submissions in aggregated or de-identified form, so that it does not identify you or any client, to understand our audience and develop our offerings.
Testimonials. We will not publish your name, likeness, or testimonial in our marketing without your permission.
7. DISCLAIMERS, LIMITATION OF LIABILITY, AND INDEMNIFICATION
Third-party services. The Site relies on and links to services operated by others, including payment, financing, hosting, email, and course-delivery providers. Their terms and privacy practices govern your use of them, and we are not responsible for their content, availability, or conduct.
Disclaimer of warranties. THE SITE AND ALL CONTENT, PRODUCTS, AND PROGRAMS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, COLOR LEGAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS CURRENT, COMPLETE, OR CORRECT FOR ANY JURISDICTION OR MATTER.
Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, COLOR LEGAL AND ITS MEMBERS (INCLUDING CRISTINA DELISE), MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST FEES, LOST DATA, LOSS OF ANY CASE OR CLAIM, ADVERSE RULING, VERDICT, SANCTION, MALPRACTICE CLAIM, OR PROFESSIONAL DISCIPLINE, ARISING OUT OF OR RELATING TO THE SITE OR ANY CONTENT, PRODUCT, OR PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR ANY CONTENT, PRODUCT, OR PROGRAM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain of these limitations, so they apply to you only to the extent permitted.
Indemnification. You will defend, indemnify, and hold harmless Color Legal and its members (including Cristina Delise), managers, employees, contractors, and agents from and against all claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) your use of the Site or any content, product, or program; (b) your use of our materials in any matter, including claims by your clients, opposing parties, courts, or disciplinary authorities; (c) your breach of these Terms; or (d) your violation of any law or the rights of any third party.
8. DISPUTE RESOLUTION
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES INDIVIDUAL ARBITRATION OF DISPUTES AND WAIVES CLASS ACTIONS AND JURY TRIALS.
Informal resolution first. Before starting any proceeding, the party with a dispute must send the other a written description of it and the relief sought. Notices to us go to [email protected]. The parties will try in good faith to resolve the dispute within 30 days after the notice is received.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any content, product, or program, including the scope or enforceability of this section, will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, in the State of New York. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs this section.
Class action waiver. Claims may be brought only on an individual basis, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person or preside over any class or representative proceeding. If this waiver is found unenforceable as to any claim, that claim will proceed in court and not in arbitration, and will be stayed pending the outcome of any individual claims in arbitration.
Exceptions. Either party may bring an individual claim in small claims court. Either party may seek a temporary restraining order, preliminary injunction, or other equitable relief in court to protect its intellectual property, confidential information, or the license restrictions in Section 5, without first pursuing informal resolution or arbitration.
Jury trial waiver. For any claim that proceeds in court, each party waives its right to a jury trial.
Time to bring claims. To the extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
Governing law and venue. These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any proceeding permitted in court will be brought exclusively in the state or federal courts located in the State of New York, and each party consents to personal jurisdiction there.
9. GENERAL TERMS
Suspension and termination. We may suspend or end your access to the Site or any product or program, without refund, if you violate these Terms or if we reasonably believe your use creates risk or liability for us or others. Sections 2, 3, and 5 through 9 survive any termination.
Changes. We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply from the date they are posted and do not apply to a dispute for which notice was given before that date. Your continued use of the Site after a change means you accept it.
Electronic communications. You consent to receive agreements, notices, and other communications from us electronically, and agree that they satisfy any requirement that they be in writing.
Entire agreement. These Terms, our Privacy Policy, and any program-specific terms that apply to you are the entire agreement between you and Color Legal about the Site and supersede any prior understanding.
Assignment. You may not assign or transfer these Terms or any license under them. We may assign these Terms, including in connection with a merger, acquisition, reorganization, or sale of assets.
Other terms. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect. Our failure to enforce a provision is not a waiver of it. We are not liable for any delay or failure caused by events beyond our reasonable control. Section headings are for convenience only.
